Seit Inkrafttreten des Amsterdamer Vertrages 1999 kann die Europäische Gemeinschaft rechtsverbindliche Instrumente in Bezug auf Flüchtlinge und andere Migranten erlassen. Die vorliegende Untersuchung beschäftigt sich mit Massenzufluchten in die Europäische Union. Jüngste Beispiele, von denen die EU-Mitgliedstaaten unmittelbar betroffen waren, sind die durch die Konflikte im ehemaligen Jugoslawien der 90er Jahre ausgelösten Fluchtbewegungen. Die EU-Mitgliedstaaten verwehrten den Menschen den Zugang zu ihren Asylsystemen und führten verschiedene Formen zeitlich begrenzten Schutzes ein. Auf der Grundlage des neu gefassten EG-Vertrages haben sie nunmehr mit der Richtlinie 2001/55/EG vom 20.7.2001 über Mindestnormen für die Gewährung vorübergehenden Schutzes im Falle eines Massenzustroms ein Instrument für ein abgestimmtes Vorgehen bei künftigen Massenzufluchten geschaffen. Nach einer Darstellung der tatsächlichen Zusammenhänge von Flucht und Migration sowie einem historischen Überblick über die juristische Herangehensweise wird der völkerrechtlich relevante Rahmen aufgezeigt. Anschließend werden die europarechtlichen Grundlagen sowie die politischen Vorgaben der Vergemeinschaftung von Flüchtlingsschutz und Migrationskontrolle behandelt. The European Union (EU) has set the objective to achieve a secure, sustainable and competitive energy. The development of a European energy policy is constantly emphasised in the declarations of EU political leaders. This thesis provides an assessment of the legal feasibility of an EU energy policy in the areas of industrial restructuring, institutional reform and security of supply. The first chapter looks into the Endesa saga, which offers a paradigmatic case concerning the tensions between energy champions and energy markets. Successive national and ‘foreign’ takeover bids for Endesa are examined at national and EU level by different authorities according to different legal regimes, which show the ambivalent contribution of the merger control to the development of an energy policy. The persistence of monopolistic structures despite energy liberalisation requires the reinforcement of the role of regulatory authorities, as analysed in chapter two. However, one cannot expect that national regulatory authorities and the newly created European Agency for the Cooperation of Energy Regulators enjoy the same powers and level of independence as their integration within Member States and the EU operates on the basis of different legal and institutional principles. Using theories of distributive justice as its point of departure, this thesis deals with the tensions created by the application of the Internal Market rules to the provision of health care services within the European Union (EU). The main aim of the work is to analyse the impact of the Internal Market rules on common values and principles shared by European health systems, such as universality, accessibility, equity and solidarity. Moreover, it also aims to contribute to a more comprehensive and balanced interpretation of the role of the provision of health services in the context of the Internal Market and European Union law. The analysis developed in this thesis is conducted using the specific issue of cross-border health care, which has been chosen to demonstrate how solid values guiding European health systems can be affected by EU law and libertarian ideas. The work is divided into six chapters. The first chapter is devoted to a literature review regarding the questions of the special moral importance of health care and of theories of distributive justice used to justify the allocation of this special good among individuals. Why do countries cooperate for the production of some weapon systems and not some others? Existing IR theories cannot fully answer these questions. In this thesis, I focus on Europe – the area in the world where armaments cooperation has been pursued more extensively. Drawing from the existing literature in international relations theory, in management studies and industrial organization, I make two claims. First, the stability of the post-Cold War era has generally given European countries – although to different extents – an incentive to gear their defense policies towards the protection of domestic jobs and the promotion of military export rather than towards capabilities development. Second, in order to achieve these goals, EU countries have strategically cooperated on the production of some specific weapon systems rather than others. By altering the structure of the market, and thus creating winners and losers, technological change can explain this variation. In my dissertation I show that European countries were more likely to pursue cooperation in armaments production when either an exogenous and relatively major technological change made their defense industries less competitive in export markets (architectural change) or when extremely advanced components were necessary to compete in global armament markets (modular innovations). Las consecuencias que el Derecho de la Unión Europea tiene para el establecimiento, interpretación y aplicación de las normas anti-abuso no sólo no pueden ignorarse sino que constituye la delimitación precisa actual de este tipo de normas, es decir, el único marco en el que pueden operar, salvo que se pretenda su aplicación a un contexto estrictamente interno. El objeto de este trabajo se limita a dos cuestiones generales: (i) determinar cuál es, en la hora actual, la noción de abuso de Derecho tributario en el Derecho de la Unión Euroea haciendo hincapié en la reciente modificación de la doctrina del Tribunal de Justicia de la Unión Europea y (ii) examinar las normas generales anti-abuso españolas, haciendo también referencia a algunas normas específicas anti-abuso (buena parte de las cuales proceden del Derecho tributario internacional) a la luz de dicha noción. The incoherence into which the European Union falls in particular areas might be conceived as weaknesses, which put into question the very conception of the European Union as a civilian power (or “soft power”) and cast some doubts about the new logic that would allegedly lie behind this conception. Does a specific European model of external action exist? Are there any differences between the way in which the European Union approaches International Law and the way in which hegemonic States do so? What is the relationship between external action and legitimation in the case of the European Union? All these questions are addressed in this article, being the underlying idea that the European model is clearly delineated in the European discourse. Nevertheless the lines of such a model are being blurred due, at least in part, to the own European Union incoherencies, which are particularly abundant in certain areas, such as immigration and asylum. Desde la fundación de la Comunidad Económica Europea, la cultura siempre ha estado presente en los Tratados comunitarios, pero su tratamiento en ellos ha ido cambiando con la evolución hacia la Comunidad Europea y de ésta a la Unión Europea. Al principio, la cultura era principalmente concebida como una excepción al mercado interior, con Maastricht pasó a ser afirmada como una política comunitaria transversal y desde Lisboa la libertad y la diversidad culturales son ya principios del Derecho europeo. En este trabajo, se estudia esta evolución tan notable de los tratados y se constata que la misma no se ha trasladado con igual claridad a la doctrina emanada por la Comisión y el Tribunal de Justicia para su desarrollo y aplicación.; Since the foundation of the European Economic Community (EEC) culture has always been present in the European Treaties, but its treatment has developed and evolved together with the transition from the EEC towards the European Community (EC) and from there to the European Union EU). At the beginning, culture was primarily conceived as an exception to the internal market. Then, in the Maastricht Treaty it became a transversal communitary policy. From the Treaty of Lisbon onwards cultural freedom and cultural diversity are already established as principles of European Law. In this paper we aim to study this remarkable evolution of the European treaties examining to which extent it has not been reflected with equal clarity in the doctrine issued by the European Commission and the European Court of Justice regarding its development and implementation.

Approved for public release; distribution is unlimited; This thesis analyzes the "updated Petersberg tasks" included in the draft treaty establishing a Constitution for the European Union. The original Petersberg tasks called for forces capable of humanitarian and rescue missions, peacekeeping operations and tasks of combat forces in crisis management, including peacemaking. The updated tasks add conflict prevention, joint disarmament, military advice and assistance, post-conflict stabilization, and support to third countries in combating terrorism. The thesis focuses on the requirements of these tasks and the capabilities of the European Union's civilian agencies and military forces to execute them. It explores the meaning of the new missions, their specific capability requirements, and the prospects for the European Union to meet these requirements. It concludes that the European Union is currently capable of undertaking the missions that require mostly civilian tools or medium-level military forces for their conduct. Why should we expect the Commission to be pulled into domestic policy execution and to accumulate something like an implementation management capacity? How should we conceptualise the Commission's linkage with post-decision management issues? Finally, how does the Commission's involvement in the application of EU policies, if any, significantly change everything? Such questions are answered in this study, which is concerned with what may be called the implementation management capacity of the European Commission. Simply put, this is the role the Commission plays in the implementation of large-scale European spending programmes. While it is true that the Commission's predominant prerogatives are to draft legislation and facilitate bargaining, it also has a role in post-decision policy management. This role is of increasing importance for the emerging governance of the European Union.

This thesis delves into the thematic of what the status of EU citizenship and the associated rights to freedom of movement yield for children in the Union. The topic has received little attention and even if discussed, children's issues are frequently tied to the rights of their parents. The dissertation adopts an alternative approach by examining children's independent position in relation to both the status of EU citizenship and the rights to freedom of movement. The method has been inspired by Article 24 of the Charter of the Fundamental Rights of the European Union, which recognizes the need to care as fundamental in the protection of children's well-being. The research demonstrates that the evolution of the influence of the concept of European citizenship and the related freedoms has strengthened children's autonomous status and secured their specific interests. Looking back on the Netherlands' role in European cooperation and integration during the 1950s and 1960s, Joseph Luns, the country's long-standing Foreign Minister, depicted himself as an exponent of a «Dutch vision». In its approach it is theoretically ambitious yet grounded in case law analysis. After an introduction into the origins of the notion of equality, the thesis sets out to deconstruct the adjudication by the European Court of Justice as well as by selected Member State courts on some of the most pressing issues of European equality law via the means of comparative institutional analysis. More specifically, it examines the diversity of applied standards of testing by the European Court of Justice, its handling of reverse discrimination and its dealing with affirmative action. Moreover, it looks at the Austrian and German case law on reverse discrimination. The collapse of central planning set in motion the reintegration of the Central European countries into the world economy. The European Union (EU), because of its proximity, economic weight, and policy-induced deep integration, has shaped these countries' politics, and economics. The process of accession to the EU - which began with the signing of the European Association Agreements in 1991 - has influenced their economic institutions, policies, and performance. The author traces the emerging architecture of commercial relations in Europe, and argues that the accession process had its greatest impact on capital flows, and later on good flows. The countries that have benefited most from accession, are those that followed the path of radical liberal reform. La economía mundial ha presentado una tendencia hacia la globalización y la integración económica; este comportamiento ha influenciado significativamente la economía Colombiana en los últimos años, promoviendo los lazos comerciales con diferentes economías a nivel mundial; esto con el objetivo de fortalecer la actividad económica tanto interna como externamente, buscando nuevas oportunidades que le permitan un crecimiento económico perdurable, a través de la inversión extranjera directa, la investigación y desarrollo, innovación tecnológica, mano de obra calificada, entre otros. Continuando esta tendencia Colombia inició un proceso de negociación de un Tratado de Libre Comercio con la Unión Europea en el año 2012, el cual culminó con éxito firmándose el 31 de Julio del 2013, mediante el decreto 1636, donde Colombia y la Unión Europea por libre albedrio se comprometieron a cumplir con todos los puntos pactados dentro del tratado. Con el objetivo de generar un diagnóstico del sub-sector lechero, se analizó la situación actual de la economía Colombiana frente a la Unión Europea, vista desde la productividad y la competitividad que se presenta en cada una de estas economías, para determinar las oportunidades o las amenazas que podría representar el tratado de libre comercio con dicho grupo económico pero específicamente concentrándose en la industria procesadora de productos lácteos. Del diagnóstico comparativo se encontró que existen grandes asimetrías entre la industria procesadora de productos lácteos en Colombia frente a la misma de la Unión Europea (UE). A través de los años y en busca de ser partícipes del fenómeno de la globalización y de la integración económica entre países, Colombia ha buscado establecer acuerdos comerciales estratégicamente adecuados para transformar la economía interna, expandirse a nivel internacional e intercambiar productos en los que no se es especializado. Ante esto, Colombia firmó el Tratado de Libre Comercio con la Unión Europea en Junio del 2012, que entró en vigencia en Agosto del 2013, y hasta el momento la situación del sector lechero ha sido crítica, pues carece del nivel de competitividad suficiente para garantizar la perdurabilidad de los pequeños y medianos productores de leche. El diagnóstico del sector lechero colombiano permite tener una visión más clara sobre las principales características de los sistemas de producción del país, es aquí donde se conocen las falencias que se presentan en el sector, pues la productividad es baja, los costos de producción son altos y los precios tienen una tendencia al alza, colocando a los productos nacionales en desventaja frente a la gran oferta internacional que invade el mercado interno con precios reducidos y con mejor calidad. Además, se identifica también que gran parte de los productores de leche son informales y por lo tanto es difícil consolidar la información referente al sector y convertirla en conocimiento para efectuar planes de cambio y transformación para mejorar la situación. Cuando se habla de los límites y fronteras de Europa, actualmente no están definidos en su totalidad, resultando problemático en la subregión del este, donde se encuentran Estados como Ucrania, Bielorrusia, Turquía y otros más. La delgada línea que divide a Europa de Asia aún es confusa, por lo cual delimitar el concepto de europeidad implica contemplar más variables que lo geográfico y cultural. De esta manera, la incertidumbre que existe está relacionada con los atributos que tiene la europeidad, y como los ciudadanos se identifican con ella. La europeidad antes que un conjunto de valores atribuible a los ciudadanos o una herencia cultural común, es un concepto difuso, efímero y esquivo para algunos autores. La trascendencia de este concepto se hace manifiesta en el artículo 49 del Tratado de la Unión Europea donde se estipulan las condiciones para ser miembro de la Unión Europea (UE). El siguiente trabajo tiene como objetivo el Estado del arte acerca de la discusión teórica de la repercusión de la unión monetaria en el principio de soberanía nacional, específicamente el caso de Gran Bretaña, ya que éste es el único país que expresa abiertamente su incertidumbre referente a algún tipo de amenaza a su soberanía. Se pretende precisar si existen criterios concluyentes, o por el contrario determinar si no hay claridad con respecto al futuro de Gran Bretaña como miembro de la unión monetaria.A partir de lo anterior, se plantean como sus propósitos particulares construir un marco conceptual acerca de la soberanía. Este estado del arte se inicia con citas de los principales autores de finales de siglo XVII y XVIII y finaliza con las posiciones conceptuales aportadas por los teóricos modernos motivados por el nacimiento de la Unión Europea como un nuevo orden político. Entre las que se citan: modelo centrico o intergubernamentalista, modelo de gobernabilidad multi-nivel, modelo neo-funcionalista y modelo federalista. Igualmente, el trabajo, busca desarrollar un marco conceptual sobre Unión Monetaria y su evolución hasta el logro de una unión fiscal europea en el periodo de 1950-2010, establecer las relaciones teóricas entre Soberanía del Estado y Unión Monetaria y por último realizar un análisis histórico hermenéutico de la Unión Europea y el caso del Reino Unido de acuerdo a las relaciones evidenciadas en los apartados teóricos entre soberanía del Estado y Unión Monetaria.; The following investigation is about the theorical discussions about the aftermath of the European Union on the principles of national sovereignity...
