At the outset, the paper briefly addresses European Union (EU) citizenship as enshrined in the Treaty on the European Union. Attention is paid on its transnational nature. The political symbolism attached to EU citizenship is also emphasised, as it tries to emulate national concepts of belonging at the EU level. Despite some achievements, flaws are nevertheless a major setback on the EU ambition for supranational citizenship’s limited scope. European Union citizenship is addressed through a twofold conceptual lens. On the one hand, it is measured in terms of the impact on citizens’ loyalties. Eurobarometer and other statistical data are scrutinised to draw a picture on whether citizens drive their loyalties to the EU or to the national (or even regional) levels. Therefore, empirical data provide an assessment of EU citizenship outcomes. Sixteen years of EU citizenship is a considerable time span to make this assessment. On the other hand, the paper asks whether the attempt to forge a complementary citizenship is out of context, considering the common understanding that citizenship is connected with taxation and representation. Thus, a normative approach of EU citizenship is also a reason of concern. Liberal democracies are anchored (among other things) on the “no taxation without representation” principle. Esta tese realizou-se com o intuito de melhor conhecer a proteção tarifária agrícola da União Européia (UE) e sua eventual associação com a Política Agrícola Comum (PAC). A hipótese implícita nesse trabalho é a de que há uma discriminação tarifária na pauta agrícola da UE; discriminação essa que estaria associada à estrutura da PAC. Nesses termos, o trabalho teve três objetivos complementares. Em primeiro lugar, buscou-se medir a magnitude das tarifas praticadas pela União Européia sobre os produtos agrícolas exportados pelo Brasil. Como segundo ponto, procurou-se identificar a existência de discriminação tarifária entre os grupos de produtos agrícolas presentes na pauta de tarifas do bloco europeu. E, por fim, avaliou-se a eventual existência de simultaneidade entre a proteção tarifária e as políticas domésticas de suporte à agricultura comunitária. An important recent World Trade Organization dispute settlement case for many developing countries concerned European Union exports of sugar. Brazil, Thailand, and Australia alleged that the exports have substantially exceeded permitted levels as established by European Union commitments in the WTO. This case had major implications for both European Union sugar producers and developing countries that benefited from preferential access to the European Union market. It was also noteworthy in the use of economic arguments by the WTO dispute settlement panel, which held that the excess sugar exports were in part a reflection of illegal de facto cross-subsidization-rents from production that benefited from high support prices being used to cover losses associated with exports of sugar to the world market. Although in principle the economic arguments of the panel could apply to many other policy areas, in practice WTO provisions greatly limit the scope to bring similar arguments for trade in products that are not subject to explicit export subsidy reduction commitments of the type that were made for sugar and other agricultural commodities.

The Czech and Slovak Customs Union (CSCU), which came into effect in January 1993, differs from regular regional trading arrangements as its goal was to minimize the economic cost of a decline in economic ties between its members rather than to set in motion the mechanism of integration. The creation of the CSCU ensured a smooth and conflict-free break up of Czechoslovakia and resulted in divergence in regulatory regimes of the two republics. This study argues that the process of mutual adjustment triggered by the emergence of national borders is over and that integration within the CSCU, similar in depth and scope to that existing within the European Union (EU), would be a desirable policy objective. By deepening integration, both the Czech and Slovak Republics would be better prepared to handle challenges associated with the EU accession. Such a regulatory realignment would also lower border costs and behind-the-border barriers to trade and result in a more attractive investment environment in both countries.

For over a century it has been the case that a person exists, at least for legal purposes, only after she has been recognized by the state. As a unique element of this acknowledgement, nationality has also been an essential component of individual identity. Now, under pressure from a variety of directions, the nature of the link between state and individual is changing, with as yet unclear implications and long-term effects. In this original and insightful analysis, Enikő Horváth focuses on three processes of legal evolution in Europe that affect the meaning of membership and individual identity: the increasing salience of supranational ‘culture’ and rights; ‘kinship’ legislation privileging non-nationals with linguistic, cultural, and ethnic ties to a given state; and the emergence of plural nationality as an acceptable (and even welcome) phenomenon. This thesis asks how the framing of policy issues in EU legislative politics influences the way issues are processed, how it affects which interests play a role during policy drafting and deliberation, and what type of political conflicts and coalitions emerge as a result. Focusing in particular on the European Commission’s role in EU policy-making, this thesis goes on to investigate how actors in EU politics define and redefine the issues at stake according to their shifting policy agendas and in doing so attempt to shore up support and marginalise political opposition. Drawing on the empirical investigation of two decades of EU biotechnology policy-making, the thesis finds that the framing of policy issues systematically affects how the complex and fragmented EU political decision-making process involves or excludes different sets of actors and interests from the diverse political constituencies of the Union. It argues that the Commission’s role in structuring the EU policy space can at times be substantial. Coherence is a powerful rhetorical device that is prevalent throughout decades of EU external relations discourse and practice. There is intuitiveness to coherence, an implied sense of ‘good fit’ between the different elements of an all-encompassing system. Yet, any attempt to concretize coherence will open up a plethora of context-specific legal and political questions. The European Neighbourhood Policy (ENP) is a recent example of an external policy drawn up explicitly with the objective of achieving coherence across different EU and Member State external policies. Positioning the ENP in the legalhistorical context of political Union, this thesis first argues why coherence is an issue at all in EU external relations, and why law is integral to attaining the ever-enigmatic single voice of the European Union. Subsequently, the text examines the role of EU external relations law in attaining a coherent neighbourhood policy. It is argued that the innovative nature of the ENP for coherence lies beyond the narrowly defined legal sphere, but stems mostly from its hybrid composition of hard legal, soft legal and nonlegal policy instruments. Es, pues, la que más probablemente pueda brindar enseñanzas para aquellas regiones del mundo que se están iniciando en este complicado proceso. Por su parte, cabe afirmar que el Mercado Común del Sur (Mercosur) es, luego de la UE, el proyecto de integración regional que ha alcanzado un mayor grado de concreción. El Mercosur es una unión aduanera que aspira a convertirse en un mercado común, al par que expresa el compromiso de fortalecer una eventual integración política. Sin embargo, las palabras han ido apartándose de los hechos. Uno de los motivos tal vez haya sido la inadecuada comprensión de la experiencia de integración europea. This PhD thesis explores the use of symbolism in European integration during the 1950s and 1960s. The thesis argues that political elites staged the early European Communities - the 1952 ECSC as well as the 1958 EEC and Euratom - as the representation of a united Europe and so tied them to a vision with much momentum in post-war Europe. This symbolic role of the Communities transcended their technocratic set-up and their narrow economic policies: it made them distinctive among the many post-war European organizations. Empirically, this thesis focuses, in separate parts, on three settings where the Communities were staged as the united Europe: the Communities’ parliamentary assem-blies (first part), the Communities’ diplomatic activities (second part), and the Communities’ polycentric seating arrangements (third part). This thesis deals with a wide array of actors who, for different reasons, participated, actively or tacitly, in the staging of the Communities: the news media and occasionally also civil society actors, governments and administrations, parties and parliaments across the original six member states as well as those of the Communities’ external partners, Britain and the United States. This thesis analyzes post-1989 organizational and capability adaptations of NATO and European naval command organizations. Specifically, this thesis examines how the adaptations of the Striking and Support Forces Southern Europe (STRIKFORSOUTH), the European Maritime Force (EUROMARFOR), and the Combined Amphibious Forces Mediterranean (CAFMED), as well as the definition of the European Multinational Maritime Force (EMMF) concept, strengthen the European Security and Defense Identity (ESDI) within NATO and endow the European Union (EU) with a naval dimension. It will argue that there are in fact two sets of external borders: those of the area in which the rules on the free movement of persons apply, and those of the Schengen area. The border crossing rights under the two corresponding sets of rules will be examined in detail. The focus will then shift to the broader Schengen rules for the management of the external borders. The thesis will discuss the rationale of the EU's interest in borders, the legislative acquis adopted, and the relation between legislation and executive action. This thesis looks at enforcement through damages claims for violations of EU public procurement rules. Despite important recent amendments to the procurement remedies regime, the damages provision remains indeterminate. The legislative inertia pressures the CJEU to give an interpretation and raises the question as to how the Court should deal with damages. While some scholars have seen the project of new governance as a purely political or functional enterprise - a mechanism of 'soft law' - the thesis will argue against such a view through an empirical analysis of a particular OMC process - the OMC for social inclusion and social protection (the OMC SPSI). While on the one hand, the OMC SPSI has achieved considerable success in creating a new social policy vocabulary in Europe, the very description of the OMC as an instrument of 'soft law' has handed considerable power to frame key policy decisions to national and European executives, while depriving Parliaments and local authorities from their normal rights of scrutiny. In Europe many EU Member States now have (or are developing) at least some sort of anti-trafficking policies (with some of them in the forefront of global anti-trafficking efforts). Moreover, the EU itself has become markedly more active with regard to curbing trafficking in human beings, as part of its migration control and police and judicial co-operation functions. However, even co-ordinated efforts such as those being worked on by the EU tend to produce only short-term 'cures' to a problem that is in truth global and structural in nature and which cannot be eradicated - or necessarily even significantly reduced - through policing and migration control measures alone. The prospect of enlarging the European Union (EU) to Central and Eastern European countries with income levels far below those of present members, questions how, and when the candidates' aspiration to converge towards EU standards of living, could possibly by fulfilled. To address these questions, this paper seeks to assess of the convergence experience of the four less developed EU members, i.e., Spain, Portugal, Ireland, and Greece, after joining the EU, and, to explore what lessons can be learned from that experience. The discussion suggests that, while theoretically possible, there is little empirical reason to fear that European integration would cause economies to diverge. Rather than being spontaneous, however, real convergence would seem to depend crucially, on the capacity of countries to tap international technological spillovers, particularly through foreign direct investment. Macroeconomic stability, effective competition on goods, and factor markets, and, a good human capital endowment are essential to harness benefits. Nonetheless...

Diageo es la multinacional líder en producción y comercialización de bebidas espirituosas Premium y cuenta con presencia en más de 80 países incluyendo Colombia, donde la industria de licores presenta una tendencia creciente consecuente con el crecimiento económico del país. Dentro de este contexto, la categoría de bebidas espirituosas juega el papel principal con productos como ron, whisky y aguardiente, con la mayoría de la participación en el mercado nacional. Sin embargo, existe en esta industria un sistema tributario que se presenta como una barrera para la expansión del mercado que tienen los bienes importados. Bajo este marco, se presenta con gran importancia la firma de un Tratado de Libre Comercio con la Unión Europea, el cual a la fecha se encuentra en una etapa avanzada después de haber sido aprobado por el Congreso en Colombia y por la Unión Europea aunque todavía no ha entrado en vigencia. El presente trabajo de investigación tuvo como propósito identificar las potencialidades de exportación de los productos agrícolas orgánicos hacia la Unión Europea, dentro del marco del Tratado de Libre Comercio entre Colombia, Perú y la UE. Esto con el fin de que tanto los pequeños y medianos productores como los exportadores colombianos pudieran identificar las oportunidades de negocio que tiene este subsector. A través de la consulta en sitios web oficiales de los diferentes países y de entrevistas con expertos sobre el tema objeto de estudio, se logró recolectar la información pertinente para el desarrollo de los objetivos planteados. This research tests the hypothesis that attitudes towards the European Union as well as the degree of identification to the EU tends to be reinforced or weakened within personal networks. European identity is considered as an innovation that spreads (or not) through personal networks. This innovation is considered as socially prestigious and, because of that, it is adopted in first place by those who are opinion leaders in their network. Using Merton’s distinction between “locals” and “cosmopolitans” leaders, it is supposed that these influents have a more cosmopolitan profile than the other members of their network.
