[conclusion]...If the concept of globalisation is to be of any use to the study of the EU, then analyses need to recognise the multiple images of globalisation that exist as well as the complexity of the EU polity and the unevenness of European integration and governance. To settle for one dimensional images of globalisation may well be a route to parsimony and to quantifiable indices, but it risks at the same time (a) debate that amounts to little more than ‘dialogues of the deaf’ and (b) explanation that uses ‘globalisation’ as a proxy for alternative (possible less fashionable) concepts. To question the analytical utility of the concept of globalisation in EU studies is not the same as suggesting that there is nothing meaningful to be said about the globalisation-Europeanisation relationship. If nothing else, the fact that ‘globalisation’ appears as a staple concept in the real world policy discourse of the EU compels a social scientific investigation of that presence. The external policies of the European Union may be viewed as the outcome of the interaction between the Member States, the European Community (acting in the context of the ‘first pillar’) and the European Union (acting on the basis of the second and third pillars). This tripartite interaction, which involves a large number of actors operating within different institutional logics, makes it challenging for the Union to conduct coherent policies, or to fulfil its objective of affirming its identity on the world stage (Article 2 TEU). The European Neighbourhood Policy (ENP) is a particularly developed expression of a policy designed to meet the challenge of ensuring coherence between the three EU pillars. As an alternative mechanism designed to offer coherent policy-making in the cross-pillar context of relations with the EU’s strategically important neighbours, the ENP does not rely on new instruments but rather offers a way of integrating existing instruments via ‘soft’ frameworks, such as European Council and Council Conclusions and Commission policy papers. The purpose of this paper is to analyze recent developments in the protection of human rights of undocumented migrants and identify unresolved controversial issues in this field. In the current international situation, undocumented migrants continue clearly to face problems concerning their status and their rights, in particular, those who have entered the territory of the State illegally (illegal entrants) or have stayed illegally even if they initially entered legally (migrants who have stayed longer than the law or their permits allow). At the UN level, the tendency in the last twenty years has been towards a gradual development of a more precise framework regarding in particular the situation of migrant workers. Furthermore, regional bodies and regional human rights law provide general standards applicable to specific cases. In particular, the European system of human rights and the inter-American system of human rights offer mechanisms to assess the respect of the commitments by States under international human rights law. The development of a uniform European trade mark law regime has taken so many different paths over the past decades that the state of the law is now more or less incomprehensible to everyone. The regime is primarily shaped by judicial creativity, and the Court of Justice of the European Union (CJEU, earlier the European Court of Justice, ECJ), has not even hesitated to set aside the letter of supranational statutes of central importance. The CJEU has explained this shift in power to make law, from the legislature to the court, simply by the need to interpret the legislation not solely on the basis of its wording, but also in light of the overall scheme and objectives of the system of which it is part. Besides the question of a democratic deficit, permeating the overall European unification process, the inconsistent application of trade mark statutes is disquieting. On one day, rights can be invoked to prevent registration of a trade mark only if use of that mark is likely to cause a change in the economic behaviour of purchasers. This thesis contributes to the literature on EU studies by analysing how and why the European Union adopted a new trade agenda in the mid-1990s that departed from previous policies. While the EU was focused largely on its internal market from the mid-1980s onwards, external trade strategy became a key item on the agenda a decade later, wrapped in a more aggressive and free-market stance. I argue that the European Commission rather than the EU member-states was the key player in the decade that followed the signature of the Uruguay Round, and introduced services into trade negotiations. More precisely, based on empirical data from the years when Leon Brittan (1994-1999) and Pascal Lamy (1999-2004) presided as EU Trade Commissioners, the thesis analyses the European Commission’s central role as a skilful ‘network creator’ both in pushing for, and legitimising, an expansion of the free-trade agenda from goods to services. This paper explores the notion of media pluralism and its application mainly from the European Union (EU) substantive and institutional law point of view so as to speculate on the possibility for a European approach to media pluralism and on the forms and routes it might take; especially once appreciated the limits and shortcomings of traditional approaches, against the background of the competence debate in respect of media pluralism and media freedom. Thus, the first section offers a theoretical (and slightly historical) background of the notion of media pluralism, in its various dimensions, at EU level. The second section, then, sketches an analysis of the notion of media pluralism, having regard to legal sources of primary and secondary EU law, as well as to the relevant European Court of Justice (ECJ) case law. Finally, a third (and open) section builds on the difficulties in traditional hard-law approaches to tackle media pluralism at EU level, and proposes some speculation on alternative modes of governance for the media at European stage: namely, the cooperation/coordination of National Regulatory Authorities (NRAs) at supranational level. RESUMEN: Este artículo trata de identificar las motivaciones que llevaron a la privatización en la Unión Europea (UE), en particular en la Europa de los 15 (UE-15). Una de las reformas económicas más importante realizadas en Europa desde los años 70 ha sido la privatización de empresas públicas, que ha atraído la atención de los académicos y políticos, cuyos trabajos han generado una extensa la bibliografía. A pesar de los numerosos estudios realizados, apenas existe acuerdo entre los especialistas sobre las razones por las cuales los gobiernos llevaron a cabo la privatización de manera simultánea y casi generalizada. Existen tres modelos dominantes sobre la privatización en la UE, que proponen explicaciones diferentes. Cross-border loss relief may well be the last milestone, barring total tax consolidation, in the European Union (EU) market integration from a tax law perspective. As the Commission’s Communication on the Tax Treatment of Losses in Cross-Border Situations demonstrates, there is yet a lot of ground to be covered in harmonizing this aspect of corporate income taxes (CITs). While the Common Consolidated Corporate Tax Base (CCCTB) proposal seems to be stalled, a series of relatively recent European Court of Justice (ECJ) cases (among others, X Holding BV) may be tilting the balance in the interest of Member States, for the first time allowing the safeguard of revenues, or the ‘balanced allocation of taxing powers’ to be the deciding argument in allowing restrictions on the offsetting of losses. Losses cannot be analysed in isolation of the rules to determine the taxable base, as they are one more piece in the tax base puzzle. In this article, I focus on two issues: multinational groups and permanent establishments (PEs), as they comprise the main problems arising in cross-border loss relief. The different methods employed to grant loss relief are assessed, as well as the new Organisation for Economic Co-operation and Development (OECD) proposals on the taxation of PEs. But the Western Balkans had to walk through Purgatory on its road to Europe. A bloody war dragged on for ten years involving all the peoples of the region. But today the peoples and the governments of the Western Balkans are committed to leaving behind their past through the European integration process for Southeastern Europe. This accession procedure is long and complicated with ample scope for difficulties to arise. Considering the region's unequal capabilities, the financial burden of reconstruction and stabilization, as well as the potentially counterproductive effects of the European Union initiatives, the problems of the Western Balkans could be better solved by including all countries of the region in the same process of European enlargement. [Introduction]: Before arriving in Australia 8 months ago, I was witness to one of the world’s present hotspots – Afghanistan. I’d like to make a couple of introductory remarks about the nature of my position there. This job was inextricably linked with the European Union’s vision. It represents an extension of the Union’s original role, to deal with the broader political issues of the day. It is obvious to me that the EU is misunderstood in this country and one of the reasons is that the political dimension of this enterprise is poorly understood. The basic idea of the Union is as a peaceful and prosperous cooperative entity. The enterprise has grown from 6 members in 1957, to 9 in 1973, to 12 members in 1981, to 15 in 1995, and probably to 25 by 2004. As the Union grows in membership, the development of a European security policy becomes increasingly important. Com a redução das barreiras tarifárias ao comércio internacional, as normas técnicas, regulamentos técnicos e procedimentos de avaliação da conformidade vêm se tornando importantes mecanismos protecionistas e de restrição ao comércio. Esse trabalho tem por objetivo estudar essas questões, tendo como foco principal a exportação para a União Européia dos equipamentos eletromédicos produzidos por pequenas e médias empresas brasileiras. Realiza-se uma revisão bibliográfica buscando-se identificar e comparar as normas técnicas, os regulamentos técnicos e os mecanismos de avaliação da conformidade para os dispositivos eletromédicos, praticados pela União Européia e os vigentes no Brasil. É desenvolvida uma pesquisa junto a PMEs Pequenas e Médias Empresas fabricantes de dispositivos eletromédicos e exportadores para a União Européia, buscando-se identificar as dificuldades encontradas, as formas de superação dessas e os apoios recebidos. Os tratados internacionais firmados após a segunda metade do século XX, em particular aqueles que pretendem superar os tradicionais acordos de livre comércio ou união aduaneira, seguem desafiando o direito contemporâneo. Por serem mais ambiciosos, ultrapassam a clássica forma de cooperação entre países soberanos e exigem uma estrutura institucional mais elaborada, capaz de fazer emergir a vontade expressa nos tratados e de estabelecer as liberdades que serão asseguradas nesse novo ambiente, uma vez que a máxima um povo, um governo, um território, não o define. O presente artigo tem como objetivo mostrar como a União Européia, por meio da atividade da Corte de Justiça das Comunidades Européias, vem restringindo a proteção à saúde em nome da efetivação do Mercado Comum Europeu, base da construção européia. Demonstra-se este fato pela análise das mais significativas decisões relativas, direta e indiretamente, à saúde emanadas por essa Corte. Constata-se o esvaziamento da noção de proteção à saúde por meio, principalmente, da interpretação estrita dos artigos(1) do Tratado das Comunidades Européias, que viabilizam a possibilidade de existência de medidas nacionais que contradigam o Direito Comunitário em nome da proteção de certos valores, aqui a saúde. Nesse contexto, a saúde enquanto medida derrogatória, o monopólio farmacêutico, o princípio de precaução encontram-se fortemente enfraquecidos.
