Tomando por hipótese fatores e habilidades influentes na gestão de projetos e de contratos, esta dissertação tem por objetivo propor um conjunto mínimo de procedimentos que oriente o planejamento da Administração de Contrato, com base no gerenciamento de riscos. Este trabalho concentra-se no estudo de um dos instrumentos específicos utilizados pelas organizações para administrar suas relações com seus empregados o contrato psicológico. Por meio de uma pesquisa descritiva, buscou-se responder se os traços de personalidade influenciam na formação dos tipos de contratos psicológicos, bem como na percepção de ruptura e violação dos mesmos. A base teórica escolhida pra o desenvolvimento desta tese é a psicologia analítica de Carl Gustav Jung. Para tanto, foi realizada uma pesquisa, utilizando-se o método quantitativo, com 528 alunos e ex-alunos de um curso de pós-graduação lato sensu. A taxa de resposta da pesquisa aplicada foi de 34,84% da amostra inicial. Uma das características da Administração Pública atual é a necessidade de uma atuação com mais qualidade e com foco em resultados traços do modelo teórico do gerencialismo. Ainda, segundo os preceitos da governança pública, propõe-se que a atividade da Administração Pública, voltada para a eficiência e para o cumprimento de metas, seja possível através da interação do Estado com outros atores sociais, tais como empresas e organizações da sociedade civil. Nesse contexto, merece destaque o contratualismo com as entidades privadas sem fins lucrativos para que auxiliem o Estado na consecução de seus objetivos, especialmente na realização de serviços públicos. O objetivo central desta tese é analisar as relações de arrendamento e parceria no meio rural brasileiro nas últimas duas décadas. Observou-se a presença do arrendamento e da parceria em todo país, com grande heterogeneidade em formato, resultados da produção e provavelmente em ganhos de eficiência. A hipótese que orientou a pesquisa é que tal heterogeneidade não se explica apenas a partir das conhecidas diferenças regionais, e que por isto é necessário conhecer - como se tentou fazer neste trabalho - os principais condicionantes que regem as relações contratuais entre arrendatários, parceiros e proprietários. Sustenta-se que o arrendamento e a parceria, que no passado tiveram presença marcante no sistema agrário brasileiro, perdem expressão como mecanismos de acesso de pequenos produtores à terra de médios e grandes proprietários. Information technology (IT) outsourcing has for a long time been a major trend in business and government. Accountability of IT outsourcing contracts in the public administration is recognized as an important factor contributing to government transparency and public services quality, given the legislation governing these contracts and the amount of related expenditures. Considering the trend towards open government data publishing, including data on outsourcing contracts, there is an interesting opportunity for citizens to participate in the open auditing of these contracts as a means to assess the good application of public resources. In this study we explore this possibility by analyzing open data published by the Brazilian Federal Court of Accounts (TCU is its acronym in Portuguese), an interesting case since this agency has a paramount role in auditing the whole Brazilian Federal Public Administration. To this end, we gathered open data from the TCU regarding all outsourced IT services contracts maintained by the agency during the years 2000-2013. This data is analyzed to verify, from an external point of view, the related duration and values, identifying diferences between the predicted and actual amounts spent and evaluating the administration of such contracts regarding legislation. With the retake of the agro-energetic policies, the Central Government in Brazil was forced to present public policies to stimulate the expansion of the sugarcane agribusiness in the nation. The agroindustrial sector related to the production of juices and sugarcane derivatives in the Goiás state, experiencing a time of great expansion due to the construction of new industrial unities, opened possibilities for the participation of new segments of the society -sugarcane suppliers and landlords- in the sugarcane agroindustrial complex via rental contracts for available lands and contracts for the supply of raw material. This research was carried out via a qualitative approach and was based upon a range of methodological procedures literature research, documental research, and interviews to obtain the dataset. The private sector has provided investment funding and services for the United Kingdom public sector schools through output-based contracts since 1996. Under these contracts firms provide accommodation and related services, while teachers, still employed by the public sector, provide the core education services. Firms bid their lowest prices, and payments to the winning bidder begin only when services become available at the defined standards. The contracts have evolved from building new schools, to bundling maintenance and rehabilitation across many schools, to setting up information technology facilities under contracts incorporating learning targets for students.

EMBA Project Report; EXECUTIVE SUMMARY: The goal of this project was to conduct research on the current method MSFSC uses to budget for its CIVMAR Support Unit (CSU) hotel contracts, how they are receipted throughout the course of the fiscal year, and finally how they are closed out at the end of the contract period. The client suspected that there were flaws in the current process and was interested in hearing any recommendations to improve the procedures in place to help alleviate the problem of over obligating the CIVMAR Pipeline Budget. Through in-person and telephone interviews, the current process for developing the Hotel Contract portion of the budget as well as the contract award, monitoring, and receipting portion were discovered. Additionally, historical hotel usage rates and historical financial data were analyzed to help determine if there were corrective actions that could be taken. In the end, it was discovered that there was a thorough process in place for awarding, monitoring, and receipting the CIVMAR Hotel Contracts and that this process was currently working as it was designed. In support of mission objectives, combatant commanding officers and sealift masters rely on contractors to act on the U.S. Navy's behalf in coordinating the delivery of supplies or performance of services. Through the years, the cost of port services around the world has increased in various magnitudes. However, the U.S. Navy's ability to track and analyze port-visit costs changes remains rudimentary. Current systems lack the functionality needed by the stakeholders to effectively and efficiently forecast port-visit costs. The researchers developed a Web-based modularized application that stores and displays invoices, generates reports, and more importantly, forecasts future port-visit costs using the standard port-visit cost forecasting model for husbanding contracts. The forecasting function of the application provides two predictive methods, namely confidence interval estimator and exponential smoothing. The analysis clearly shows that low requirement variability improves the reliability of the interval, while high frequency of port-visits increases the accuracy of the exponential smoothing results. The capabilities of the application provide stakeholders with a valuable tool to analyze port-visit requirements and costs trends.

The DoD has spent more on services than on supplies, equipment and goods together, totaling approximately 57% of total acquisition expenditures and nearly a third of the total DoD budget. As a result, the agency must give greater attention to the management of services acquisition. Stakeholder theory illustrates how acquisition team members often have conflicting goals and objectives, leading to differing definitions and measurements of a successful service contact. We used stakeholder theory to address the following questions (1) how are successful service contracts within the DoD being defined by different stakeholders, (2) how are service contracts being measured within the DoD by different stakeholders, (3) how should service contracts be defined and measured within the DoD. To be an informed buyer in government, two distinct skill sets are required: contracting skills and subject matter expertise. For goods and services which have complex engineering inputs, the subject matter knowledge required is engineering expertise. While government procurement and contracting guidelines recognise the importance of both skill sets, their emphasis is on contracting skills with only passing reference to subject matter expertise Access to technical expertise is becoming a more critical issue for governments due to changes in the administration and type of contracts, and the skills available in the public sector. Devolution and decentralisation of government procurement powers are increasing the decision making power of individual agencies and contract staff, mega-contracts and the increasing technological complexity of contracts are increasing the penalties for making uninformed decisions, and a 20% reduction in the number of engineers in the public sector over the last decade has reduced significantly government's in-house engineering expertise. The present study generates a specialized dataset of road sector contracts for Bank-financed projects in 14 countries of Europe and Central Asia. The data sample covers 200 completed or ongoing road works contracts signed between 2000 and 2010. Trends for each country are captured through the following indicators: (i) difference between contract values and their engineers' estimates; (ii) cost overruns; (iii) time overruns; (iv) bidding indicators for contracts with and without prequalification: number of firms that applied for prequalification, number of prequalified firms, number of firms that bought bidding documents, number of bidders, number of disqualified bidders; (v) time elapsed between bid opening and contract signing dates; (vi) cost per kilometer of similar works; (vii) road works unit costs; and (viii) ratios between supervision contract values and the related road works contract values. An inventory of risks is developed for each road works contract using a checklist of possible entry points of corrupt activities or red flags. The frequency of observations is measured for the selected types of red flags from a sample of 200 road works contracts surveyed. The contracts with complaints received by the Bank's Integrity Vice Presidency (INT) are examined separately to check if they exhibit a pattern of indicators consistent with the presence of allegations of corruption or fraud. The study looks further into the determinants of road rehabilitation and reconstruction costs. It concludes with selected recommendations to sustain the platform fostering governance and integrity in the procurement and implementation of road sector contracts under Bank-funded operations.

The study is based on a new specialized dataset generated for the road sector contracts of Bank-financed projects in Sub-Saharan Africa. It is organized as follows: Chapter two describes the data and a set of indicators constructed to perform comparative assessments of the procurement and implementation processes across 13 African countries. The author studies the allocation-between a central government and a local authority--of responsibility for planning, financing, and operations for the delivery of health services, in the context of an incomplete contracts model. In this model, inputs are required of both the central government and local authorities but they are unable to write down, and commit to, a complete and binding contract describing the actions both should take. The model is meant to capture the tradeoff between central and local authority in decisions about both financing and the provision of services. Each party provides a specific input--for example, the central government establishes a drug procurement system while the local authority designs and implements an incentive scheme to get doctors to carry out their responsibilities appropriately. Information technology (IT) outsourcing has for a long time been a major trend in business and government. Accountability of IT outsourcing contracts in the public administration is recognized as an important factor contributing to government transparency and public services quality, given the legislation governing these contracts and the amount of related expenditures. Considering the trend towards open government data publishing, including data on outsourcing contracts, there is an interesting opportunity for citizens to participate in the open auditing of these contracts as a means to assess the good application of public resources. In this study we explore this possibility by analyzing open data published by the Brazilian Federal Court of Accounts (TCU is its acronym in Portuguese), an interesting case since this agency has a paramount role in auditing the whole Brazilian Federal Public Administration. To this end, we gathered open data from the TCU regarding all outsourced IT services contracts maintained by the agency during the years 2000-2013. This data is analyzed to verify, from an external point of view, the related duration and values, identifying diferences between the predicted and actual amounts spent and evaluating the administration of such contracts regarding legislation.
