O Ministério Público, desde o período imediatamente anterior à Constituição da República de 1988, recebeu novas funções que não faziam parte da clássica titularidade da ação penal pública. Juntamente com essa novel plêiade de funções, atribuiu-se também à instituição novas ferramentas para a consecução de suas finalidades, marcadamente ligadas à tutela e à defesa de interesses metaindividuais. O manejo desses instrumentos no âmbito do próprio Ministério Público possibilita, em grande medida, a resolução concertada de conflitos, contornando a morosidade e a onerosidade do sistema judicial. Essas atividades, que possuem natureza jurídica de função administrativa, apresentam muitas zonas de discricionariedade, que, mal interpretada e manejada, pode desbordar em arbitrariedade disfarçada de independência funcional. Introdução: A gestão escolar está intrinsecamente relacionada à área educativa, e requer que o gestor dirija os trabalhos desenvolvidos pelos professores de forma a garantir melhores resultados possíveis em prol da formação dos alunos, visando à qualidade do processo ensino aprendizagem. Este estudo apresenta a relação entre o pedagógico e o administrativo da gestão escolar focada no gestor de escola profissionalizante em enfermagem. Objetivos: descrever como os gestores de escolas de ensino profissionalizante em enfermagem compreendem o papel do gestor e conhecer como se processa o trabalho da gestão pedagógica administrativa destes gestores. Método: realizado um estudo exploratório, descritivo de caráter qualitativo. Foram realizadas oito entrevistas com gestores escolares de escolas privadas e públicas. Utilizada a análise de conteúdo preconizada por Bardin. Após a análise surgiram quatro categorias: 1. Função Administrativa do Gestor; 2. Função Pedagógica do Gestor; 3. Formação Pedagógica e Administrativa do Gestor; 4. Cotidiano do Trabalho do Gestor. Resultados: os depoimentos mostraram como ocorre a relação entre o pedagógico e o administrativo na escola e como se processa a gestão. A Constituição de 1988, seguindo a moderna tendência de delegação à administração de funções que vão além do exercício de poder de polícia e de atividades econômicas pela via direta, traçou como objetivo da máquina pública a efetiva contribuição para o alcance de um modelo que equilibre, de um lado, as liberdades sociais, com amplo desenvolvimento e dignidade humana, e, de outro, o exercício da liberdade de iniciativa empresarial, fruto do modelo capitalista em vigor. O presente trabalho tem por escopo analisar a aplicabilidade da Lei Federal n. 9.784/99 (Lei de Processo Administrativo Federal LPAF). A partir do exame das expressões doutrinárias do direito e do processo administrativo no Brasil, busca-se investigar a extensão de sua incidência, tendo-se como premissa inicial o fato de a referida Lei representar um verdadeiro quadro ou fonte normativa primordial de ordenação da atuação administrativa, pautando requisitos mínimos para instauração, instrução e decisão relativos à formação e posterior execução da vontade funcional da Administração Pública. Nesse sentido, busca-se discutir a fórmula ou regime geral de incidência da LPAF, tendo como fundamento sua estipulação baseada em normas básicas e sua subsidiariedade em relação às espécies processuais administrativas reguladas por leis específicas. In recent years, many countries, both developed and developing, have engaged in a process of decentralization of health service delivery and/or other functions of the health system. In most cases, decentralization has been adopted to improve accountability to local population, efficiency in service provision, equity in access and resource distribution, or to increase resource mobilization. Ghana has a long history of local government, going back to pre-independence times of the nineteenth century. By 1859 Municipal Councils were established in the major coastal towns of the then Gold Coast. Native Authorities, Councils and Courts were also established to administer law and order under the indirect authority of the colonial government; the limitations of this system was repeatedly put forward in the 1930s and 1940s, and reforms were introduced in 1951 by the Local Government Ordinance (Ahwoi 2010). The government has embarked in a decentralization policy since independence, which was strengthened and amplified by the local government act of 1993 and other legislations. This report evaluates the framework of decentralization reforms instituted in decentralizing countries. Decentralization is a multi-faceted process which includes giving discretion to local governments and establishing accountability mechanisms at three different levels of governance: political, administrative and fiscal. Therefore, the analysis of the decentralization reforms should also be based on an inter-disciplinary approach. The report applies this framework to ten countries and two sectors and uses the case studies as the primary data collection tool. These case studies provide detailed contextual analysis of the political, administrative and fiscal aspects of decentralization. The countries identified for the case studies are Angola, Ethiopia, Tanzania, Uganda, Kerala/India, Philippines, Guinea, Burkina Faso, Rwanda and Punjab/Pakistan. Following years of civil war that ended in 2002, Sierra Leone has pursued a policy of decentralization, devolving responsibility for many government functions to the Local Council level. The aims of this policy include achieving a more equitable and inclusive access to public services across the national territory, in part to alleviate regional inequities that contributed to the civil war. The implementation of the decentralization policy has faced many obstacles, however, including the need to rebuild local government institutions and capacity after 30 years of centrally dominated governance; the limited devolution of financial resources; and multifaceted political economy hurdles. European Governance is more than just a policy instrument without legal significance. Its regulatory sub-divisions, such as Comitology, the Lamfalussy procedure, and the growing number of European administrative agencies, have colonized substantive parts of the law-shaping and law-making processes. This contribution argues that European Governance is a distinct phenomenon that cannot be easily reconciled with traditional notions of legislation and administration, but needs to be theorized differently. Accordingly, its legal shape has to be adjusted to this new situation, too. Neither a - still only vaguely defined - concept of ‘accountability’, nor a non-binding policy concept of ‘good governance’ can fill this gap. A re-definition of European Governance - as an ‘integrating administration’ – has to take the new developments of a distinct European administrative governance sphere seriously. At the same time, it has to address the specific legitimatory problématique of the new governance structures in a sufficient manner. Approved for public release; distribution is unlimited.; Marine Administrative Message 441/99 directed that Marine Corps administration be consolidated above the battalion level. Secondly, Marine Administrative Message 027/04 directed that over 1,300 Marine Corps billets be civilianized. To embrace both of these directives, this thesis has attempted to describe the consolidation of administrative functions within U.S. Marine Forces, Pacific to the installation level and the civilianization all non-inherentlygovernmental structure. The active duty manpower savings would total 120 marines while actually decreasing the cost of the activity of conducting administration for Oahu-based units by $1 .3 million. It is necessary to consolidate if all 120 billets are to be civilianized. If consolidation does not occur, then the Marine Corps administrator billets within the deploying units will remain inherently-governmental and unavailable for conversion. It is only through the centralizing of non-military tasks that civilianization can be optimized. A deployable cell concept is described to support the 14 deploying units from Oahu. This concept will have to dovetail with future technologies to successfully deploy over-the-horizon administrative support.

Spatial Data Infrastructures (SDIs) comprise a set of policies aimed at coordinating the numerous layers of spatial information upon which society functions. To achieve this objective effectively an SDI must encompass policies, standards, and procedures for organisations to cooperatively produce and share geographic data. One of the most fundamental problems restricting the objectives of SDI is the fragmentation of data between different agency boundaries. Essentially this problem stems from the differing criteria and methods adopted by agencies designing individual boundary units. This current lack of coordination and unstructured methodologies for subdividing space has lead to difficulties in integrating, analysing and exchanging information across boundaries and through time. To further the objectives of SDIs in providing mechanisms for data integration, methods by which agencies may derive administrative boundaries using a common framework, which still meet their own individual requirements are being investigated. Through the development algorithms and standards for the design of administrative boundaries within a spatial hierarchy it is envisaged that SDI will incorporate data integration and cross analysis to its range of existing functions.

The Chinese economy has experienced an unprecedented 30-year period of economic growth and development that has delivered enormous social and economic benefits to the people but has had seriously adverse and continuing effects on the state of the environment. The government is well aware of the problem. Over the last five to ten years, environmental objectives have become increasingly important in priorities set under successive national five-year plans. Manas Taalimi, a health sector development program covering the period of 2006-2010, was developed in 2005 by the Ministry of Health as a successor to the first broadly successful Manas I strategy and is an expansion of the health goals embedded in the National Poverty Reduction Strategy (NPRS) and Comprehensive Development Framework (CDF). The First and Second Health Sector Reform Projects financed by the Bank used a traditional project implementation structure with a stand-alone Project Implementation Unit (PIU). The Second Health Sector Reform Project divided fiduciary and administrative functions from technical functions by having two separate but related units: a PIU for the administrative and fiduciary work and a Technical Coordination Unit (TCU) for component coordinators and technical issues. Under Manas Taalimi these fiduciary and technical functions will be integrated into the country's health sector systems and structures. This arrangement with high-level policy coordination and fiduciary functions integrated into the health sector s fiduciary systems and technical decisions taken in each of the Ministry's own technical units is an evolution from the PIU/TCU model employed under Health II and is responsive to the sector wide approach (SWAp) that has been adopted for Manas Taalimi.

The objective of this decentralization study is to provide analysis and policy advice to the new Malagasy government on how to proceed with the decentralization strategy it inherited from the previous government. Public sectors in the Pacific Islands are frequently described as being 'too big' and as 'crowding out' private sector economic activity. Reducing their size, it follows, would provide much-needed space for private sector expansion and result in higher levels of economic growth. This paper addresses these issues, arguing that there is not a good case for supposing that public sectors in the Pacific Islands are excessively large, when the challenges of public administration and public service delivery in such small, remote, dispersed, and divided states are taken into account. Rather than being preoccupied with their size, it would be more useful to focus on whether the resources available to their public sectors are being used efficiently and effectively to provide an adequate range and quality of administrative functions and public services. The paper also argues that, at a general level, the case for crowding out in the Pacific Islands is not particularly compelling, and that it would be more useful to focus on the trade-offs for the private sector of public sector engagement in any given administrative function or area of service delivery. La Constitución Política de 1991 introdujo el concepto de participación como dato fundamental de su estructura. Un estudio ligero permite evidenciar una cantidad de artículos que regulan la materia participativa sin embargo, dichos preceptos se encuentran sin una relación de convexidad precisa. En cuanto al tema de la participación del administrado en la administración pública, como género de la especie que engloba las normas precisas sobre el ejercicio de funciones administrativas por particulares, el problema es de mayor complejidad; ello debido a que el problema participativo supone el estudio de teorías sociológicas que explican el fenómeno desde perspectivas que superan el ámbito normativo de los preceptos que consagran dicho fenómeno. The objective of the present study was to investigate hospital administrator's expectations about the administrative role played by nurses, utilizing functions proposed by the Neoclassical Theory of Administration: planning, organization, direction and control as theoretical references. An instrument established in TREVlZAN (1989) was applied to 11 hospital administrators. The results showed they expect the four functions to be done by nurses.
