A pesquisa abordou o tema dos contratos de gestão na área educacional procurando responder à seguinte pergunta: como a abordagem contratual emergiu e se consolidou como instrumento de gestão na regulação da educação básica mineira, no âmbito estadual? O objetivo do estudo foi examinar o desenho da política educacional, elaborado a partir de 2003, com a implementação da reforma gerencial do Estado. Para tal, buscou-se explicitar a instituição do contratualismo, do ponto de vista jurídico-legal e político-administrativo. Buscou-se, ainda, por meio da análise dessas duas dimensões jurídico-legal e político-administrativa examinar o modelo de Estado que passa a ser construído em Minas Gerais. Para tanto, privilegiou-se a investigação de natureza qualitativa, valendo-se de um corpus documental que, por sua vez, foi submetido à análise de conteúdo. Mestrado em Estudos Sociais da Ciência; A investigação e a transferência e valorização económica do conhecimento científico e tecnológico têm vindo a assumir-se como missões centrais das instituições de ensino superior, juntando-se, deste modo, à sua inicial e mais tradicional missão de ensino. Esta evolução, sentida também nas instituições de cariz politécnico, acarreta, consequentemente, modificações ao nível das práticas profissionais dos seus professores. Neste contexto, o nosso objetivo é conhecer e analisar o conjunto das atividades desenvolvidas pelos docentes dos institutos superiores politécnicos portugueses no âmbito da sua prática profissional, em especial no que se refere ao seu envolvimento em atividades de investigação e de transferência e valorização económica do conhecimento. Para o efeito, recorreu-se à aplicação de um inquérito por questionário, de administração direta em modalidade online, aos docentes dos quinze politécnicos nacionais públicos, tendo sido obtida uma taxa de resposta que ronda os 12% da população. O tratamento dos dados envolveu análise estatística descritiva e inferencial. We present the design of a banner advertising auction which is considerably more expressive than current designs. We describe a general model of expressive ad contract/bidding and an allocation model that can be executed in real time through the assignment of fractions of relevant ad channels to specific advertiser contracts. The uncertainty in channel supply and demand is addresscd by the formulation of a stochastic combinatorial optimization problem for channel allocation that is rerun periodically. We solve this in two different ways: fast deterministic optimization with respect to expectations; and a novel online sample-based stochastic optimization method-- that can be applied to continuous decision spaces--which exploits the deterministic optimization as a black box. This thesis consists of three studies of labor markets where differences in talent are associated with very large differences in income. The unifying theoretical feature is the view that the analysis of such labor markets should take into account the scarcity of jobs, which is a natural consequence of the combination of finite demand and positive production costs. In Chapter 1 we propose a model where an industry-specific talent can only be revealed on the job and publicly. Individual inability to commit to long-term contracts leaves firms with insufficient incentives to hire novices, inducing them to bid excessively for the pool of revealed talent instead. This causes the market to be plagued with too many mediocre workers, inefficiently low output levels, and excessive rents for the known high talents. We argue that high wages in professions such as entertainment and entrepreneurship may be explained by the nature of the talent revelation process in those markets, and suggest potential natural experiments for estimating the welfare loss and the excessive talent rents predicted by the model. Este estudo tem o objetivo de verificar o tratamento dado aos contratos de Locação Comercial de Devedor Locatário em Recuperação Judicial. A lei 11.101/2005 determina, em seus artigos 117 e 119,VII, que os contratos bilaterais não se resolvem pela falência e que na falência do locatário, o administrador judicial pode, a qualquer tempo, denunciar o contrato. Porém, a lei é lacônica a respeito do processo de Recuperação Judicial. Então, o estudo pretende verificar a aplicabilidade dos artigos pertinentes à falência, aos contratos de Devedor submetido ao processo de Recuperação Judicial. The execution of contractual agreements between two private parties is generally limited to the good faith enforcement of expressed contract rights and implied rights established by common law. However, a multitude of rules significantly affect the rights and responsibilities of all parties to a contract when one of those parties is the Government. Not only do these rules dictate the content of Government contract provisions, but they affect the application of common law in determining implied rights and responsibilities and the method of the Government's administration of the contract. This paper will strive to illustrate both the differences and similarities between private and military construction contracting. It will then more specifically compare important clauses in the U.S. Navy's General Provisions for construction contracts and the American Institute of Architects' most important construction contract document, the A201, General Conditions of the Contract for Construction. Approved for public release, distribution is unlimited; This thesis examines the process by which enlisted goal shares are generated by Commander, Navy Recruiting Command (CNRC) and assigned to Navy Regional recruiting commands. Through use of an econometric goaling and forecasting model employed by CNRC and a less complicated weighting system used by Regions, goal shares are generated using factors believed to accurately predict future recruiting success. The factors used in the new contract prediction model include local economic conditions, population demographics, and recruiting resources. This thesis evaluates these factors to obtain a clear understanding of how each affects the establishment of goal shares. The various levels within the recruiting organization are analyzed, to include a discussion on how each of these levels prioritizes assigned goals, specifically accessions and new contract objectives, and the reasons why these priorities differ across levels within the organization. The thesis analyzes the role of past production data and Production per Recruiter (PPR) in establishing goal. Recruiter incentives and potential impacts of these incentives on the attainment of quality contracts are also discussed. Finally, the accuracy of CNRC forecasts is evaluated and recommendations are made to help ensure the continued success of these forecasts well into the future. This final report is the fourth and final deliverable in Castalia's assignment, funded by the World Bank, to improve how contingent liabilities are managed in Pakistan. The report presents recommendations on how Pakistan should improve its policies and processes for issuing and managing contingent liabilities associated with public private partnerships (PPPs) in infrastructure. The author studies the allocation-between a central government and a local authority--of responsibility for planning, financing, and operations for the delivery of health services, in the context of an incomplete contracts model. In this model, inputs are required of both the central government and local authorities but they are unable to write down, and commit to, a complete and binding contract describing the actions both should take. The model is meant to capture the tradeoff between central and local authority in decisions about both financing and the provision of services. Each party provides a specific input--for example, the central government establishes a drug procurement system while the local authority designs and implements an incentive scheme to get doctors to carry out their responsibilities appropriately. The responsibility for delivery of services is identified with the ownership of essential infrastructure, such as the clinic or hospital. This thesis investigates the impact of lack of information and decentralization of decision-making on the performance of inventory, supply chain, and transportation systems. In the first part of the thesis, we study two extensions of a classic single-item, single-period inventory control problem: the "newsvendor problem." We first analyze the newsvendor problem when the demand distribution is only partially specified by some moments and shape parameters. We determine order quantities that are robust, in the sense that they minimize the newsvendor's maximum regret about not acting optimally, and we compute the maximum value of additional information. The minimax regret approach is scalable to solve large practical problems, such as those arising in network revenue management, since it combines an efficient solution procedure with very modest data requirements. We then analyze the newsvendor problem when the inventory decision-making is decentralized. In supply chains, inventory decisions often result from complex negotiations among supply partners and might therefore lead to a loss of efficiency (in terms of profit loss).; (cont.) Strategic suppression of grades, as well as early offers and contracts, are well-known phenomena in the matching process where graduating students apply to jobs or further education. In this paper, we consider a game theoretic model of these phenomena introduced by Ostrovsky and Schwarz, and study the loss in social welfare resulting from strategic behavior of the schools, employers, and students. We model grading of students as a game where schools suppress grades in order to improve their students' placements. We also consider the quality loss due to unraveling of the matching market, the strategic behavior of students and employers in offering early contracts with the goal to improve the quality. Our goal is to evaluate if strategic grading or unraveling of the market (or a combination of the two) can cause significant welfare loss compared to the optimal assignment of students to jobs. To measure welfare of the assignment, we assume that welfare resulting from a job -- student pair is a separable and monotone function of student ability and the quality of the jobs. Assuming uniform student quality distribution, we show that the quality loss from the above strategic manipulation is bounded by at most a factor of 2, and give improved bounds for some special cases of welfare functions.

TreatJS is a language embedded, higher-order contract system for JavaScript which enforces contracts by run-time monitoring. Beyond providing the standard abstractions for building higher-order contracts (base, function, and object contracts), TreatJS's novel contributions are its guarantee of non-interfering contract execution, its systematic approach to blame assignment, its support for contracts in the style of union and intersection types, and its notion of a parameterized contract scope, which is the building block for composable run-time generated contracts that generalize dependent function contracts. TreatJS is implemented as a library so that all aspects of a contract can be specified using the full JavaScript language. The library relies on JavaScript proxies to guarantee full interposition for contracts. It further exploits JavaScript's reflective features to run contracts in a sandbox environment, which guarantees that the execution of contract code does not modify the application state. No source code transformation or change in the JavaScript run-time system is required. Design by Contract (DbC) and runtime enforcement of program assertions enables the construction of more robust software. It also enables the assignment of blame in error reporting. Unfortunately, there is no support for runtime contract enforcement and blame assignment for Aspect-Oriented Programming (AOP). Extending DbC to also cover aspects brings forward a plethora of issues related to the correct order of assertion validation. We show that there is no generally correct execution sequence of object assertions and aspect assertions. A further classification of aspects as agnostic, obedient, or rebellious defines the order of assertion validation that needs to be followed. We describe the application of this classification in a prototyped DbC tool for AOP named Cona, where aspects are used for implementing contracts, and contracts are used for enforcing assertions on aspects.

The data include the relative energy spectrum, angular distributions in the neutron knock-out channel (6He+n) as well as diffractive dissociation and inelastic scattering into the (6He+2n) channel. The data are compared with corresponding results from the well-known halo nucleus 6He. In both cases it is found that neutron knock-out is the dominating reaction channel. The relative energy spectrum (6He+n) shows a structure, which is interpreted as being due to the Iπ=3/2− resonance in the 7He ground state with about equal contribution from its Iπ=1/2− spin–orbit partner.; The 7He resonance shows a spin alignment similar to that observed in 5He, but with a smaller anisotropy indicating that the structure of the 8He ground state is more complicated than that of 6He.; The data in the (6He+2n) channel were used to identify resonances in the excitation energy spectrum of 8He. This dissertation is written in three progressively restrictive parts. Part I is a set of two expansive essays on collaborative supply chain management that proposes several new perspectives and interconnections between current day global business and economic issues, and the evolving supply chain structures and decision-making paradigms that depend on extensive inter-firm collaboration. Part I also develops new guidelines for both practitioners as well as academic researchers in their quest to incorporate collaborative requirements as an explicit component of existing planning frameworks and modeling approaches. Part I further comments on how the technological evolution of manufacturing, service, and general business processes have led to decentralized structures that require a fundamentally collaborative approach to the planning of such processes. We also argue that existing supply chain decision-making and planning approaches are modeled in the fashion of corporate and enterprise resource planning systems, which given their scope, limit the extent of collaboration in both planning and in execution. The arguments and discussion in this part are not specific to any particular supply chain function and is without technological bias. Esta dissertação trata do instituto da cessão da posição contratual. Embora a assunção de dívida seja hoje aceita pelo ordenamento pátrio, tal como a cessão de crédito, a cessão da posição contratual não foi disciplinada pelo Código Civil. Conquanto ninguém duvide da existência do instituto como negócio jurídico inominado, sua ausência de disciplina suscita debate sobre as regras a ele aplicáveis. Inicialmente, é feita uma breve contextualização histórica para demonstrar as dificuldades que o instituto enfrentou para ser aceito pela doutrina e legislações, tendo surgido inicialmente por conta das necessidades da vida prática. Porque frequentes as tentativas de aproximar a cessão da posição contratual com outros institutos, também é demonstrada a singularidade dessa figura jurídica e as suas diferenças com outras semelhantes (novação, sub-rogação, adesão ao contrato, subcontrato e contrato com pessoa a declarar). O conceito, terminologia e natureza jurídica do instituto são exaustivamente abordados em capítulo próprio.
