The main issue of this work is the institutionalization of mediation within the Courthouse and the pre-conditions for having a good relationship between mediation and the Judiciary. This issue is analyzed from both procedural and institutional points of view. The procedural perspective falls on the mediation due process (minimal but meaningful due process standards) and on the differences between the procedural and substantial justices. The institutional perspective falls on the design of the Court-Connected Mediation Programs and on the roles of the players who participated in these programs: judges...

Introduction Institutionalization in a nursing home restricts autonomy, most notably free will, free choice, and free action. Decreased physical activity and fitness are predictive of disability and dependence (Rikli & Jones, 2013; Tak, Kuiper, Chorus, & Hopman-Rock, 2014); however little is known about the impact of these factors on institutionalization. Thus, this study aimed to analyze the impact of physical activity and fitness and on the risk of elderly people without cognitive impairment become institutionalized. Methods This cross-sectional study involved 195 non-institutionalized (80.14.4yrs) and 186 institutionalized (83.85.2yrs) participants. Cognitive impairment was assessed using Mini-Mental State Examination, physical activity was assessed using the International Physical Activity Questionnaire, and measures of physical fitness were determined by the Senior Fitness Test. Results: Multivariate binary logistic analysis selected 4 main predictors of institutionalization in both genders. The likelihood of becoming institutionalized increased by +18.6% for each additional year of age, while it decreased by -24.8% by each fewer kg/m2 in BMI, by -0.9% for each additional meter performed in the aerobic endurance test and by -2.0% for each additional 100MET-min/wk of physical activity expenditure (p<0.05). Values ≤50th percentile (age ≥81yrs...

The aim of this paper is to verify the nature of the relationship between the concept of legitimacy and the phenomenon of institutionalization of operational auditing at the Court of Auditors in a context of institutional isomorphism. A documental examination was conducted covering the period of 1987 to 2004 and 18 people involved in the aforementioned activity at the Court of Auditors were interviewed. The results suggest that there is a relationship between isomorphism and legitimacy but only concerning one type of legitimacy. The phenomenon of isomorphism acts in the sense of checking cognitive legitimacy while other factors are at work which are connected to the culture and institutional environment of the country, which interfere in the dimension of moral legitimacy, resulting in institutionalization of the activity at a secondary level in the analyzed organization. It was seen that the process of institutionalization, in this case, has a circular characteristic, in which the phases of innovation, diffusion, partial saturation and partial deinstitutionalization follow one another cyclically, modifying the activity of operational auditing over time at the Court of Auditors.

The neoinstitutional theory has been characterized by some scholars in the field of organizational studies as a supposedly deterministic approach. We will demonstrate in this paper that this characterization cannot be impinged on the neoinstitutional perspective in a generalized way, but only to a dichotomic reading of it, that is typical of monoparadigmatic views of the process of institutionalization. With this demonstration, we defend the idea of the institutional theory as a multiparadigmatic theory. To this end, we present arguments for a recursive approach of the institutionalization process, highlighting that the notions of structure, agency and interpretation are more suitably dealt with when defended as fundamental elements of institutionalization as a recurrent, guaranteed process that is conditioned, not determined, by a certain degree of stabilization of social systems. We conclude the essay with methodological considerations on the consequences of the use of the proposal for a recurrent systemic-process approach of institutionalization for the development of research in the field of organizational studies

Many organizations are applying efforts to improve their software processes, in face of the premisse that states that the quality of the processes used to develop and maintain software has a major influence over the products generated. These efforts are typicaly in the form of software process improvement (SPI) initiatives, with the general objetive defining and/or improving software processes, as well as institutionalizing them. Nevertheless, once it involves changes in the way of work of organizations, SPI provokes changes in organizational culture, and is impacted by this culture. This is reflected in SPI literature, that presents organizational culture as a critical success factor in SPI implementation. The focus of this research is the investigation of the correlation between organizational culture and the effectiveness of SPI initiatives. In order to do this, two fundamental questions were considered: (a) how the culture of an organization can influence the degree of institutionalization of a defined/improved software process, and (b) what can be done to increase the degree of institutionalization of a defined/improved software process, once this institutionalization involves a cultural change. To accomplish this, a case study was conducted in two software organizations (where only one of them institutionalized its software process) with the purpose of analysing how their cultural profiles may have influenced in these different outcomes. It was also conducted a search to identify recommendations for cultural change in Organizational Culture literature. The application of these recommendations was evaluated in a comparative way in both organizations. Additionaly...

Indonesia has made significant increase in rural sanitation access and services from 20.64 percent in 2006 to 44.09 percent in 2013. A study conducted in 2012 estimated a capacity gap of 12,000-18,000 sanitation professionals (from engineers to community workers) to meet the 2015 millennium development goal (MDG) targets, with 30 percent of community health centers not having frontline sanitation personnel. Capacity building programs have so far been largely conducted by technical units, projects, and local government offices. Following an assessment on how and where to best address the issues, the technical assistance (TA) recommended a transformative approach, away from project-based cascading training where training is done at national level and then repeated and cascaded to provincial, district, sub-district, and village levels to an institutionalized capacity building program. The institutionalization of capacity building program targeted two primary audiences: future professionals (pre-service) addressed through integrating national strategy for community-based total sanitation (STBM) modules into health polytechnic schools curriculae and current professionals (inservice) addressed through accredited and certified training programs...

This paper analyzes the extent to which the ‘world’s only elected supranational assembly’ has become institutionalized. More specifically, it asks the following question: Has the European Parliament become more complex, autonomous, specialized and universalistic? Using the concepts derived from the theory of institutionalization, I attempt to address this question and develop our knowledge of the institutional evolution of the European Parliament.

Building on Casal Bértoa and Mair´s (2010) work on the institutionalization of post-communist party systems and as a response to their uneasiness with the failure of the party politics literature to determine what causes party system institutionalization in the first place, this paper addresses the following question: what are the sources of party system institutionalization in post-communist East Central Europe? In particular, what is it that explains the institutionalization of the Hungarian and Czech party systems in clear contrast to those of Slovakia and Poland, which are considered weak and under-institutionalized, respectively?

In classical party democracy, elections serve as an “instrument of democracy” (Powell 2000): they are the mechanism to connect policy preferences of the electors (within the electoral arena) to the political production (within the legislative arena). At the European level the linkage seems to be lost because the political actors performing in the two arena are not the same and the logics of behaviour are quite different. The EU calls for truly “Europarties” to become more democratic in its procedural and substantive prerequisites and this entails not only a progressive emancipation of party structures at European level but also an integration between them. In fact, we will have full Europarties only when the two party structures at EU level are either independent from national parties and linked to each other: if intra- and extra- parliamentary faces become really European and connected entities, legislators will be accountable to voters and, consequently, democratic deficit will decline. The main aims of this paper are, firstly, to investigate if and to what extent political parties at European level are able to perform the electoral and legislative functions in the two separated arena and, secondly, if intra- and extra- parliamentary faces of the Europarties are still separated or...

Institutionalization processes have an ambivalent effect on organizational long-term success. Even though they foster organizational stability and permanence, they also bring about rigidity and resistance to change. As a result, successful organizations are likely to lose their competitive advantage over time. The paper addresses this issue through the investigation of the institutionalization processes of two long-lived companies: General Electric, a firm that has been a long-term success and its rival, Westinghouse, which was broken up after eleven decades of existence. The longitudinal, multilevel analysis of firms and industry has identified two different modes of organizational institutionalization. The reactive mode gives rise to rigidity and change resistance, much like institutional theory predicts; the proactive mode, on the other hand, neutralizes those negative effects of institutionalization processes. In the reactive mode, structure predominates. In the proactive mode, agency plays a major role in organizational institutionalization, and in managing the organization's relations with the environment, clearly contributing to environmental institutionalization.

Eis os objetivos deste texto.; The presented discussion is part of an investigation about a Brazilian housing policy known as Minha Casa Minha Vida (My Home My Life) and its relations to the housing social movements in Brazil. Our fieldwork and literature review revealed that housing social movements are part of a different historical moment and, therefore, of a different conception of what they are and what they were made for. These movements...

This research aims to investigate the process of institutionalization of Junior Enterprises (JEs) of the public universities of Ceará, according to the model of institutionalization of Tolbert and Zucker (1999) in its three phases: habituation, objectification and sedimentation. This research is bibliographic, being classified as a descriptive study of qualitative and quantitative nature. The study was conducted in 10 JEs of Ceará. During data collection, questionnaires administered with members, and interviews with the presidents of the JEs were used. The results show that the main reason for the emergence of IOs in public universities of Ceará was the need to combine theory with practice, the main actors in the process of these entities were students. No resistance groups, but there is a threat at the prospect of continuity due to high turnover in JEs. The JEs are among the phases of objectification and sedimentation and isomorphic characteristics, among JEs, are related to the sharing of best management practices.; http://dx.doi.org/10.5007/1983-4535.2015v8n1p1Essa pesquisa tem por objetivo investigar o processo de institucionalização das empresas juniores (EJs) das universidades públicas do Ceará, tendo como modelo o processo de institucionalização de Tolbert e Zucker (1999) em suas três fases: habituação...

The purpose of this article is to examine the institutionalization of a region of the United States of America: the Texas Lower Rio Grande Valley. It will use and build on theories of regional institutionalization, geography, and demography by Paasi, Harvey, Gilbert, and other theorists. This research asks how history, geography, and demography challenge the present and future regional institutionalization of the Texas Lower Rio Grande Valley. To answer this question, recent case studies on institutionalization and regional development in Canadian and U.S.-Mexican regions will be used to explain phenomena.
